By entering the Yahoo!7 Ski Banff/Lake Louise Canada Promotion (the “Competition”), you are agreeing to the following terms and conditions:

1 STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.

2 WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia.
2.2 Directors, management, employees and their immediate families of Yahoo!7 Pty Limited, Banff/Lake Louise Tourism, m.Net Corporation Ltd. and their associated agencies and companies are not eligible to enter.

3 HOW TO ENTER
3.1 The Competition commences on Monday 24 November 2008 @ 00:01 AEDT and concludes on Monday 15 December 2008 @ 23:59 AEDT (“the Competition Period).
3.2 Entrants must log onto (http://www.yahoo7.com.au/lakelouise) and enter their name, email address, postal address (including postcode) and contact daytime telephone number (including STD area code).
3.3 All entrants (including winners) in the Competition may enter as many times as they like but must not use scripting for multiple entries, which will be deemed invalid.
3.4 Entries must be received by Monday 15 December 2008 @ 23:59 AEDT.
3.5 Entrants under 18 years of age must have parent or legal guardian approval to enter this Competition.

4 PRIZES
4.1 There will be one (1) major winner drawn to win a trip for two (2) people to Canada (Rockies) (the “Winner”)

4.2 Total prize value is $12,000. Prize value is correct as at 31 October 2008 and the Promoter accepts no responsibility for any change in prize value between now and the ultimate date on which the prize is taken.
4.3 Unless expressly stated in these Terms and Conditions all other costs are to be met by the Winner and their chosen travel companion including (but not limited to) ground transfers in Australia and any other transfer, meals, drinks and/or tips, travel and/or health insurance, any excess baggage charges, spending money, incidentals, mini-bar, laundry, room service, telephone calls, activities, taxes (including departure taxes), energy surcharges, gratuities, services charges, passports. Travel insurance is the responsibility of the Winner and their companion. The Promoter and the Sponsor are not liable for any costs incurred if the Winner or their companion travel without insurance. A credit card imprint or cash deposit may be required from the Winner at check-in to the hotel, for all incidental charges.
4.4 Flights leave from the Winner’s nearest capital city. The Winner and their travelling companion must travel on the same flight. Travel arrangements to and from the Winner’s nearest capital city airport do not form part of the prize and are the responsibility of the Winner.
4.5 The prize MUST be taken between 15 January 2009 and 12 April 2009 subject to availability and avoiding school holidays, Christmas and New Year periods.
4.6 If an entrant is under 18 years of age at the time of the draw this prize will be awarded to their parent or legal guardian.
4.7 All prize components are not transferable or redeemable for cash or frequent flyer points.
4.8 Travel does not accrue frequent flyer points.
4.9 All bookings for flights and accommodation are subject to availability.
4.10 The prize is non-refundable, nor are any unused portions refundable.
4.11 Both the prize Winner and their chosen travel partner must travel together.
4.12 In participating in the prizes, the Winner agrees to participate and co-operate as required and the Winner (and their companion) agree to grant the Promoter a perpetual and exclusive licence to use any footage and photographs in all media worldwide and the Winner (and their companion) will not be entitled to any fee for such use.
4.13 The Winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
4.14 The Winner should seek independent financial advice about any tax implications that may arise from the prize winnings.
4.15 Full details of prizes can be obtained from the website at (http://www.yahoo7.com.au/lakelouise).
4.16 The Sponsor is solely responsible for fulfilment of all prizes.

5 HOW TO WIN
5.1 There will be one (1) major winner drawn from the pool of entrants. Each entrant who has entered the Competition over the duration of the Competition as stated in clause 3 will be entered into the draw.
5.2 The draw will take place at m.Net Corporation Ltd., Level 2, 8 Leigh Street, Adelaide, South Australia 5000 at 10:00 AEDT on Tuesday 16 December 2008.
5.3 Winner will be notified by a phone call on the day of the draw, and a letter advising the Winner of their prize will also be express posted. Winner details will be published in the Public Notices section of The Australian newspaper on Monday 22 December 2008.
5.4 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.5 It is a condition of accepting the prize that the Winner must comply with all the conditions of use of the prize and prize supplier’s requirements.
5.6 It is a condition of accepting the prize that the Winner (and any companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
5.7 Subject to state government legislation, if the Winner cannot be contacted, or has not contacted the Promoter by 09:00 AEDT on Tuesday 23 December 2008 a redraw will be held at 10:00 AEDT on Tuesday 23 December 2008. The original winner’s prize will be forfeited and the original winner will have no further claim. The draw will take place at m.Net Corporation Ltd., Level 2, 8 Leigh Street, Adelaide, South Australia 5000. Winner details will be published in the Public Notices section of The Australian newspaper on Monday 12 January 2009.

6 NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to government legislation.
6.2 Yahoo!7 Pty Limited, Banff/Lake Louise Tourism, m.Net Corporation Ltd. and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 Yahoo!7 Pty Limited, Banff/Lake Louise Tourism, m.Net Corporation Ltd. and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
(a) during the draw;
(b) whilst undertaking any travel won on or connected with their entry into the draw;
(c) in the participation in any prize;
(d) in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion:
(e) arising from or related to any problem or technical malfunction of any computer equipment, software, intent connection, any injury or damage to entrant’s or any other person’s computer software related to or resulting from participation in this Competition.
6.4 Yahoo!7 Pty Limited, Banff/Lake Louise Tourism assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.
6.5 If for any reason this Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to government legislation.

7.3 By entering this Competition you agree to Yahoo!7’s use of your personal information as described on Yahoo!7's Privacy Policy http://privacy.yahoo.com/privacy/au. All entries become the property of Yahoo!7 and your name may be included on a database. By entering this Competition you consent to Yahoo!7 including your name in future mail, email, SMS or other campaigns. By entering this Competition you consent to Yahoo!7 sharing your personal information with the Sponsor, and you acknowledge that the Sponsor is solely responsible for its use of that information.
