Yahoo!7 Be A Better Planet Answers Promotion

1. Eligibility

You must be an Australian resident at the time of entry. Employees and agents of Yahoo!7 Pty Limited, (“Yahoo!7”), its affiliates, subsidiaries, advertising and promotional agencies (all of the foregoing, together with Yahoo!7 Pty Limited, collectively referred to as “Promotion Entities”), and the immediate family members and persons living in the same household as such individuals, whether related or not, are not eligible to participate or win.

2. How To Enter

The Promotion begins at 12:00 AM AEST on May 14, 2007 and ends at 11:59 PM AEST on June 8, 2007 (the “Entry Period”). You may enter the Promotion by completing the following two steps (an “Online Entry”):

(i) Registration: Visit http://au.yahoo.com/green (the "Website") and complete the official entry form for the "Be A Better Planet" promotion (the "Promotion"). If you are not an existing Yahoo! account holder, you must register for a free Yahoo! ID. Your registration must be completed by the conclusion of the Entry Period.

(ii) Answer: Once you have completed your registration for the Promotion, visit http://au.answers.yahoo.com/ ("Yahoo!7 Answers") and follow the instructions to submit your answer (an "Answer") to the following question: “How could $50,000 create a more sustainable environment in Australia?” (the “Promotion Question”).

For purposes of these Terms and Conditions, “receipt” of an Online Entry occurs when Yahoo!7’s servers: (a) record the entry information upon clicking the “Submit Entry” button during registration and (b) confirm that you have provided an Answer to the Promotion Question, each in accordance with the timelines above.

You may enter this Promotion as many times as you wish.

3. Conduct

By entering the Promotion, you agree to comply with and be bound by these Terms and Conditions. The Terms and Conditions will be posted at the Promotion website throughout the Promotion. Failure to comply with these Terms and Conditions may result in disqualification from the Promotion. You further agree to comply with and be bound by the decisions of Yahoo!7, which will be final and binding in all respects. Yahoo!7 reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Promotion or any Yahoo! website; (b) violating the Terms and Conditions; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Yahoo! property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

4. Winner Selection and Notification

The Prize will be awarded in respect of the Answer that Yahoo!7 and its nominated panel of judges determines in their absolute discretion to be the best answer (the “Winning Answer”). All prize-related judging will be conducted by a panel of judges selected by Yahoo!7, whose decisions are final. This is a game of skill, and chance plays no part in determining the outcome.

The Entrant who submits the Winning Answer will be contacted by telephone and email after the competition has closed. Return of any prize/prize notification as undeliverable, or inability of Promotion Entities to contact a potential winner may result in disqualification and selection of an alternate winner from among remaining non-winning entries received on a first- come, first-served basis.

Potential prize winner may be required to provide Promotion Entities with proof that he/she is the authorised Account holder as described above.

5. Prizes

The Prize details are as follows: (i) Yahoo!7 will contribute AUD$50,000 (the “Funds”) to a not-for-profit organisation (the “Implementing Organisation”) for the purposes of implementing the Winning Answer. Yahoo!7 will select the Implementing Organisation in its discretion; and

(ii) the Entrant who submits the Winning Answer will be invited to attend an event to be held by Yahoo!7 in Sydney to award the Funds to the Implementing Organisation. The winner will receive 1 night’s twin share accommodation in a 4 star Sydney hotel and return economy airfares from the winner’s nearest capital city, and AUD$500 spending money. This component of the Prize must be taken on the date notified by Yahoo!7 to the winner, and is subject to booking and flight availability. If the winner is under the age of 18 years, they must be accompanied by a legal guardian or somebody over 18 years when taking the prize. Meals, taxes, insurance, transport to and from the departure point, transfers and all other ancillary costs are the responsibility of the winner.

Prizes cannot be transferred or exchanged and cannot be redeemed for cash. Winners should seek independent financial advice about any tax implications that may arise from the Prize winnings.

6. General Conditions

This Promotion is governed by the laws of New South Wales, Australia.

By entering, you: (a) release and hold harmless the Promotion Entities, and their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this promotion, or while traveling to, preparing for, or participating in any prize-related activity.

Except where prohibited by law, a winner’s acceptance of a Prize constitutes permission for the Promotion Entities to use such winner’s name, address (city and state only), statements, photograph, voice and/or likeness for any advertising and promotional purposes relating to the Promotion, online and in print or any other media, without further compensation, consideration, review or consent.

Yahoo!7 reserves the right to alter these terms and conditions, withdraw any Prize from the Promotion or alter or cancel all or part of the Promotion in its absolute discretion without notice.

In the event of a dispute, Yahoo!7's decision is final and no correspondence will be entered into.

7. Limitations of Liability

Subject to any restrictions in law, the liability of the Promotion Entities however arising, whether by breach of any condition or warranty implied by statute or of this agreement or of any duty of tort (including negligence) is limited to the total value of the Prize.

In addition to any other rights, Yahoo!7 reserves the right at its sole discretion to disqualify any individual who tampers with the entry process or the operation of the Promotion who is determined at Yahoo!7’s absolute discretion to be acting in violation of these Terms and Conditions.

Yahoo!7 does not accept responsibility for lost, late, misdirected, illegible or mutilated entries or for any computer, online, telephone or technical malfunctions that may occur.

Yahoo!7 reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and select winners from among all eligible entries received prior to the cancellation.

8. Privacy

By entering the Promotion, you agree to Yahoo!7’s use of your personal information as described in Yahoo!7’s Privacy Policy, located at http://privacy.yahoo.com/privacy/au/.
